These Terms & Conditions (“Terms”) govern your use of the Locatour mobile app and related services (the “Service”), provided by Hatchet Pty Ltd (“Locatour”, “we”, “us”). By using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. Eligibility

You must be old enough to form a binding contract in your jurisdiction and meet the minimum age required by applicable law to use the Service. If you are a minor, you may only use Locatour with the consent and supervision of a parent or guardian.

2. Your account

You’re responsible for the activity on your account and for keeping your sign-in details secure. Provide accurate information and let us know of any unauthorised use.

3. Acceptable use

You agree not to:

• Cheat or attempt to fake, automate, or manipulate check-ins, location, or rewards (for example, spoofing GPS or submitting photos you didn’t take on the spot).
• Trespass, enter closed or restricted areas, or break any law, rule, or signage to reach a location.
• Harass, endanger, or harm others, or damage any place or property.
• Upload content that is unlawful, infringing, harmful, hateful, or that you don’t have the right to share.
• Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorised access to the Service.

We may suspend or terminate accounts that breach these Terms.

4. Locations, safety, and assumption of risk

Locatour encourages outdoor exploration of public places. You are responsible for your own safety. Always assess conditions, follow local laws, signage, and closures, respect private property and the environment, and use your own judgement about whether a place is safe to visit.

Locations are provided for general information. We don’t guarantee that any place is safe, open, accessible, or suitable, and we are not responsible for conditions at any location. You participate at your own risk.

5. Your content

You keep ownership of the photos and content you create (“User Content”). By submitting User Content, you grant Hatchet Pty Ltd a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display it as needed to operate and provide the Service.

You are responsible for your User Content and confirm you have the rights to share it and that it doesn’t break these Terms or any law. We may remove content that violates these Terms.

6. Our intellectual property

The Service — including the Locatour name, logo, software, design, game systems, and content we provide — is owned by Hatchet Pty Ltd or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from it except as allowed by law or with our permission.

7. Rewards have no monetary value

Experience, levels, streaks, achievements, and other in-game progress are for entertainment and recognition only. They have no monetary value, cannot be exchanged for cash, and may be adjusted, reset, or discontinued as part of operating the game.

8. Service changes and availability

We may change, suspend, or discontinue any part of the Service at any time. We aim to keep it available but don’t guarantee uninterrupted or error-free operation.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Hatchet Pty Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or injury arising from your use of the Service or your visit to any location. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify and hold harmless Hatchet Pty Ltd from claims, losses, and expenses arising out of your use of the Service, your User Content, or your breach of these Terms or any law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service and its users.

13. Governing law

These Terms are governed by the laws of Western Australia, Australia, without regard to its conflict-of-laws rules. Disputes will be subject to the courts of that jurisdiction, except where applicable law gives you other rights.

14. Changes to these Terms

We may update these Terms from time to time. We’ll post the updated version here and update the effective date. Continued use of the Service means you accept the updated Terms.
